1. Agreement to Terms
By accessing or using KeeperVoice ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
KeeperVoice is operated by Stephen Frittelli, an individual doing business as KeeperVoice, based in Texas, United States ("we," "us," or "our").
2. Description of Service
KeeperVoice provides two products:
The Voice Keepsake ($79 one-time): You submit a voice recording. We create a voice profile using AI voice cloning technology and use it to narrate a classic audiobook in that voice. The resulting audiobook is delivered to you by email, typically within minutes of submission.
The Living Library (subscription tiers from $19): Members may submit original or public domain text and have it narrated in their preserved voice. Tiers are based on word count. Membership is included with The Voice Keepsake purchase.
3. Eligibility
You must be at least 18 years of age to use this Service. By using the Service, you represent that you meet this requirement.
4. Voice Recording and Consent
4.1 Ownership and authority. By submitting a voice recording through KeeperVoice, you represent and warrant that:
- You are the person whose voice is being recorded, OR
- You have explicit, informed consent from the voice owner (or their legal representative if deceased) to submit their voice for this purpose
- You have the legal right to submit the recording and authorize its use as described in these Terms
4.2 Permitted use. You authorize KeeperVoice to use your submitted voice recording solely to:
- Create a voice profile using ElevenLabs' AI voice cloning technology
- Generate the audiobook or narration you have ordered
- Re-create the voice profile as needed to fulfill future Living Library orders
4.3 Prohibited submissions. You may not submit a voice recording of any person without their knowledge and explicit consent. You may not submit recordings obtained through deception, recording without consent, or any unlawful means.
4.4 No impersonation. KeeperVoice services may not be used to create voice content that impersonates any person for fraudulent, deceptive, or harmful purposes. Any such use is a material breach of these Terms and may be reported to appropriate authorities.
5. Content Rules — Living Library
5.1 Permitted content. You may submit:
- Original writing that you authored
- Works published before January 1, 1928 that are in the public domain
5.2 Prohibited content. You may not submit:
- Copyrighted text published in 1928 or later (books, articles, song lyrics, screenplays, etc.) without explicit written permission from the copyright holder
- Content that is defamatory, obscene, threatening, or unlawful
- Content that impersonates or misrepresents any person
- Content designed to deceive, defraud, or harm any individual
5.3 Copyright compliance. We use automated copyright screening to review submitted text. We reserve the right to reject any submission that appears to violate copyright. Repeated violations may result in account termination without refund.
5.4 Your responsibility. You are solely responsible for ensuring that any text you submit complies with these rules. By submitting text, you represent that you have the legal right to do so.
6. Payments and Pricing
6.1 Pricing. Current pricing is listed on our website. We reserve the right to change pricing with reasonable notice.
6.2 Payment processing. Payments are processed by third-party payment processors. We do not store your payment card information.
6.3 Living Library tiers. Living Library narrations are priced per submission based on word count:
- A Moment: up to 200 words — $19
- A Story: up to 500 words — $29
- A Chapter: up to 1,500 words — $49
- A Volume: up to 5,000 words — $89
- A Book: up to 10,000 words — $149
- Over 10,000 words: contact keepervoice.ai@gmail.com for custom pricing
7. Refunds
Please refer to our Refund Policy, incorporated into these Terms by reference.
8. Intellectual Property
8.1 Your voice and content. You retain all rights to your voice and any original text you submit. You grant KeeperVoice a limited license to use your voice recording and submitted text solely to fulfill your order.
8.2 Audiobook content. The audiobooks we deliver to you are for your personal use. The underlying public domain texts are in the public domain. The voice performance, as generated by AI, is delivered to you for your personal and family use.
8.3 KeeperVoice property. All other content on keepervoice.com — including our website design, branding, copy, and technology — is the property of KeeperVoice and may not be reproduced without permission.
9. Disclaimers
9.1 Service availability. We strive to deliver audiobooks within minutes of receiving your recording. Delivery times may vary based on system load, recording quality, and other factors. We do not guarantee specific delivery times.
9.2 Voice quality. The quality of the voice clone depends substantially on the quality, length, and expressiveness of the recording you provide. We cannot guarantee that the resulting voice will meet your expectations if the submitted recording is of poor quality, very short, or does not meet our recommended guidelines.
9.3 No warranty. THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT TO THE FULLEST EXTENT PERMITTED BY LAW.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, STEPHEN FRITTELLI AND KEEPERVOICE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM.
11. Indemnification
You agree to indemnify, defend, and hold harmless Stephen Frittelli, KeeperVoice, and their service providers from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your submission of voice recordings without proper consent
- Your submission of copyrighted content without authorization
- Any claim that your submitted content harmed a third party
12. Governing Law and Disputes
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the Service shall be resolved in the courts of Texas.
You agree to attempt to resolve any dispute informally by contacting us at keepervoice.ai@gmail.com before initiating formal proceedings.
13. Termination
We reserve the right to suspend or terminate your access to the Service at any time for violation of these Terms, fraudulent activity, or any other reason at our sole discretion. Upon termination for cause, no refund will be issued.
14. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a new "Last updated" date. Continued use of the Service after changes are posted constitutes acceptance.
